1. About these terms

These Terms of Service apply to your use of pacificheatpumpcovers.com and to any order you place with us. By using the site or placing an order, you agree to these terms. If you do not agree, please do not use the site.

2. About us

The site is operated by Pacific Outdoor Solutions, trading as Pacific Heat Pump Covers, based at 55 Dunlop Road, Onekawa, Napier, New Zealand. You can contact us at enquiries@pacificoutdoorsolutions.co.nz or 06 842 0512.

3. Using the site

You agree to use the site only for lawful purposes. You must not attempt to interfere with the site, gain unauthorised access to it, or use it in a way that could damage or disable it. We try to keep the site available and accurate, but we do not guarantee it will be uninterrupted or error-free. We may change, suspend or withdraw any part of the site at any time.

4. Products and descriptions

We aim to describe our products accurately, including dimensions, materials and finishes. Powder-coat colours shown on screen are indicative only. Screen calibration, lighting and batch variation mean the finished product may differ slightly from what you see online. If exact colour matching matters, ask us for a physical sample before ordering. Some images are renders or examples and may show optional features or a different size to the one you are ordering. We may improve or change product specifications over time.

5. Sizing and the Find Your Size tool

Our Find Your Size compatibility tool and size guides are provided as a guide only. Recommendations are based on manufacturer specification sheets, which manufacturers revise between model years. You are responsible for measuring your own unit, including width, height, depth and any protruding pipes, brackets or fittings, and for confirming the cover you order will fit before you place your order. We are not liable for a cover that does not fit because the unit's actual dimensions differ from the published specifications, or because measurements supplied to us were incorrect. If you are unsure, contact us before ordering and we will help.

6. Prices and GST

All prices are in New Zealand dollars and include GST unless stated otherwise. Prices exclude delivery unless stated. We may change prices at any time, but changes will not affect orders we have already accepted. If a product is listed at an obviously incorrect price due to an error, we may cancel the order and refund you in full rather than supply at that price.

7. Orders and acceptance

Placing an order is an offer to buy. Your order is accepted when we send you an order confirmation or dispatch the goods, whichever happens first. We may decline or cancel an order if the product is out of stock or unavailable, there is an error in the price or description, we cannot verify your payment or delivery details, or we reasonably believe the order is fraudulent. If we cancel an order you have already paid for, we will refund you in full.

8. Payment

We accept the payment methods shown at checkout, currently credit and debit card (via Stripe) and PayPal. Payment is taken in full at the time of order unless we have agreed otherwise in writing. For custom and made-to-order items, we may require full payment or a deposit before manufacture begins.

9. Delivery

We deliver within New Zealand. Delivery costs are calculated at checkout based on your address and the size of your order. Delivery timeframes given on the site or in correspondence are estimates only. We are not liable for delays caused by couriers, weather, or events outside our control. Risk in the goods passes to you on delivery. Please inspect your order on arrival and tell us within 7 days if anything is damaged or missing.

10. Custom and made-to-order products

Custom covers, custom colours and made-to-order sizes are manufactured specifically for you. Because of this, orders cannot be cancelled or changed once manufacture has begun, and custom items are not returnable for change of mind. Your statutory rights under the Consumer Guarantees Act 1993 for faulty goods are unaffected. We will confirm all custom dimensions and colours with you in writing before manufacture, and it is your responsibility to check and approve these details.

11. Returns, refunds and faults

Our Returns and Refunds Policy forms part of these terms, so please read it before ordering. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you are buying as a consumer. If goods are faulty, not as described, or not fit for purpose, you are entitled to a remedy under that Act. Where you are buying for business purposes, you and we agree that the Consumer Guarantees Act does not apply, to the extent permitted by law.

12. Warranty

We warrant our covers against manufacturing defects from the date of delivery, subject to normal use and proper installation. This warranty does not cover fair wear and tear, scratches or fading from normal outdoor exposure; damage from impact, misuse, modification or incorrect installation; corrosion caused by coastal, geothermal or chemically aggressive environments beyond the coating's rated exposure; or covers used in a way that restricts airflow contrary to our clearance guidance. To make a claim, contact us with your order number and photos of the issue.

13. Installation, airflow and safety

Our covers are designed to allow the clearances stated in the product information. You must install the cover so that the manufacturer's minimum clearances for your heat pump are maintained, keep the unit's airflow, drainage and service access unobstructed, and ensure any electrical or refrigeration work is carried out by a suitably qualified and licensed tradesperson. We are not liable for damage to a heat pump, loss of efficiency, or any warranty issue with the heat pump itself arising from installation that does not follow the manufacturer's requirements.

14. Intellectual property

All content on the site, including text, images, logos, designs, product renders and the sizing tool, is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce or use it commercially without our written permission.

15. Liability

To the maximum extent permitted by law, and subject to clause 11, our total liability to you for any claim relating to a product or order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss, including loss of profit, loss of use, or loss of opportunity. Nothing in these terms excludes liability that cannot lawfully be excluded.

16. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these terms.

17. Governing law

These terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts.

18. Changes to these terms

We may update these terms from time to time. The version in force at the time you place an order is the version that applies to that order. The current version is always available on this page.
